Summary:
 Senate Bill 72 (SB 72) amends property law to allow nonprofit condominium associations to transact business remotely.
 
Legislation Overview:
 Senate Bill 72 (SB 72) amends property law in several sections to allow nonprofit condominium associations to transact business via simultaneous, remote electronic means.  
SECTION 1 amends Meetings to insert text that allows a notice may be sent by electronic mail or equivalent electronic transmission; provided that the recipient has agreed to electronic notice in advance.
SECTION 2 amends Subsection A of Quorums to allow persons may cast a vote via simultaneous, remote electronic means.
SECTION 3 amends Subsections B and C of nonprofit corporations Voting as follows: 
Both subsections are amended to remove “his” and insert “the member’s”.
B. A member entitled to vote may vote via simultaneous, remote electronic means. 
SECTION 4 amends nonprofit corporations throughout Quorum to allow persons to vote  
via simultaneous, remote electronic means.
SECTION 5 amends nonprofit corporations under Directors’ Meetings to insert via simultaneous, remote electronic means.
 
Current Law:
 Senate Bill 72 does not allow actions by remote electronic means. The amended codes are:  
Section 1: Property Law Section 47-7C-8 NMSA 1978 Meetings.
Section 2: Property Law Section 47-7C-9 - Quorums.
Section 3: Corporations Section 53-8-15 -Nonprofit Corporations
Section 4: Corporations Section 53-8-16 - Quorum.
Section 5: Section 53-8-22 NMSA - Directors’ Meetings
