Summary:
 Senate Bill 101 (SB 101) proposes increasing fees for services relating to livestock.
 
Legislation Overview:
 Senate Bill 101 (SB 101) amends the Livestock Code Section 77-2-29 NMSA 1978 (being Laws 1981, Chapter 357, Section 2, as amended) in multiple subsections to increase fees fixed by the board for services rendered and inserts Subsection O to add a fee for moving a head of livestock to or from a seasonal grazing allotment. 
Section 1specifies fee changes as follows: 
A. an inspection or permit fee not to exceed $1.00 (up from $.16) per head to be charged for the importation or exportation of sheep and goat; the board shall not increase the inspection fee more than $.04 in any one fiscal year. Also, a service chargen ot to exceed $50.00 (up from $10) for each inspection request; 
B. for recording a transfer of a brand not to exceed $200 (up from $100); 
C. for recording a brand or researching a brand not to exceed $200 (up from $100); 
D. a fee for additional copies of certified copies of brands not to exceed $20 per copy (up from $10);  
E. for the recording of a holding brand not to exceed $200 (up from $100), which recording shall be valid for one year, and an additional fee not to exceed $100 for each annual renewal; 
F. for the re-recording of brands not to exceed $200 (up from $100);
G. for the inspection of livestock not to exceed $2.50 (up from $.50 cents) per head; the inspection board may not increase the inspection fee more than $.10 in any one fiscal year;  Also, a service charge not to exceed $50 (up from $10) for each inspection request; 
H. for the inspection of hides not to exceed $2.50 (up from $.50) per hide; the board may not increase the inspection fee more than ten cents ($.10) in any one fiscal year; Also, a service charge not to exceed $50 (up from $10) for each inspection request ; 
I. for the handling of the proceeds of the sale of an estray not to exceed $75 (up from $10); 
J. for the impoundment of trespass livestock not to exceed $50 (up from $10) per head per day; 
K. for the licensing of a livestock auction market not to exceed $100 (up from $25); 
L. for issuing a transportation permit not to exceed $100 (up from $50); 
M. for the licensing of a cattle or sheep rest station not to exceed $100 (up from $25); 
N. for issuing a certificate of brand exemption not to exceed $200 (up from $100; and 
O. for moving a head of livestock to or from a seasonal grazing allotment in an amount equal to 50 percent of the fee for the inspection of livestock per head set by the board, rounded up to the nearest cent.
SECTION 2 makes the effective date July 1, 2025. 
Current Law:
 Livestock Code Section 77-2-29 NMSA1978 specifies fees for services in multiple sections. 
Amendments:
 Senate Bill 101 is amended by the Senate Finance Committee (SFC) as follows:
SECTION 1 is amended by the SFC in Section 77-2-29 NMSA 1978 (being Laws 1981, Chapter 357, Section 2, as amended) regarding FEES in Subsection O to insert a definition so it reads as follows:
O. a fee for moving a head of livestock to or from a place for seasonal grazing in an amount equal to fifty percent of the fee for the inspection of livestock per head set by the board pursuant to Subsection G of this section and Section 77-9-38 NMSA 1978, rounded up to the nearest cent. For the purposes of this subsection, "seasonal grazing" means the movement of livestock from one grazing location to another grazing location; provided, however, that both grazing locations are under the control of the same producer and the ownership of the livestock does not transfer upon the movement of the livestock.
