Summary:
 House Bill 91 (HB 91) allows the New Mexico Public Regulation Commission (NMPRC) to approve additional rate structures. 
Legislation Overview:
 House Bill 91 (HB 91), amends Section 62-8-6 NMSA 1978, a law which currently prohibits public utilities from making or granting any unreasonable preference or advantage to any corporation or person, is amended to provide a new allowance for rate structures in certain circumstances.

The New Mexico Public Regulation Commission (NMPRC) is explicitly allowed to approve rates that seek to reduce the burden of energy costs on low-income customers, and also rates that are designed to decrease or eliminate customer arears, for the purpose of increasing affordability and continuity of service. 
 
Current Law:
 The law does not currently explicitly allow rate structures designed to reduce the burden of energy costs on low-income customers or rates designed to decrease or eliminate previous debt to the utility company.

 Amended February 7, 2025 in HGEIC

HGEICa/HB 91: The House Government, Elections and Indian Affairs Committee amends House Bill 91 as follows:

1. On page 2, line 4, after "rates", insert "and programs". 
2. On page 2, line 5, after the semicolon, insert "and". 
3. On page 2, strike lines 6 through 11. 4. Reletter the succeeding subsection accordingly.
