Senate Bill 99 (SB 99) amends the Clean Transportation Fuel Standard Program rules in Section 74-1-18 NMSA 1978 by prohibiting transportation fuels from being assigned a carbon intensity value of less than zero.Current Law:
Section 74-1-18 NMSA 1978 mandates the Environmental Improvement Board (EIB) to specify certain requirements for utilities and statewide standards and their application under this section. It defines transportation fuel as electricity or a liquid, gaseous or blended fuel, including gasoline, diesel, liquefied petroleum gas, natural gas and hydrogen, sold, supplied, used or offered for sale to power vehicles or equipment for the purposes of transportation and defines carbon intensity as the quantity of fuel lifecycle greenhouse gas emissions per unit of fuel energy. It requires the EIB to promulgate the rules for this fuel standard program no later than 1 July 2026. It allows for credits for certain technology-neutral mechanisms, activities and projects; these credits can be banked for future use or sold.
