House Bill 452 (HB 452) amends Section 62-16-5 NMSA 1978 of the Renewable Energy Act. It clarifies the calculations for a qualifying generator as defined by federal law, that is net metered. In that case, the public utility will have been deemed to purchase all the energy generated by the qualifying facility; and all the energy consumed on site by the qualifying facility will be included in the total retail sales for the purpose of calculating the renewable portfolio standard.Current Law:
Section 62-16-5 NMSA 1978 currently determines that the owner of a generator of renewable energy system owns the energy for purposes of calculating renewable energy certificates unless provided for by contract. If the facility is a qualifying generator as defined in federal law, then the public utility purchasing the energy owns the renewable energy certificates.
